Dr. saw a young man who appeared to have syphilis. Since it was considered contagious with simple contact, he told man to leave boarding house. Pt. didn't. Dr. told landlady about pt's. Syphilis. She threw pt. out, he sued Dr. NE Sup. Ct. ruled "the private privilege ends where the public peril begins."
Dr. had a professional obligation to protect the public. See Tarasoff.
